Terms of Service
Effective: May 5, 2026
1. Eligibility & Account
You must be at least 18 years old to create an account. You agree to provide accurate, current, and complete information when registering and to keep that information up to date. Account identity is managed via a third-party authentication provider (Clerk); your use of that provider is also subject to its terms and privacy policy.
2. Roles & Access
The Service offers two role-based programs:
- Referee. Independent technical reviewers (physicists, high-voltage engineers, aerospace researchers, and comparable practitioners). Referee status is granted at our sole discretion based on submitted credentials. Referees may access gated experimental data, post review comments (subject to moderation), and submit up-or-down verdicts on published builds and tests.
- Builder. Reserved for participants in our forthcoming open replication program. Not currently active. Account creation now does not entitle you to Builder access when the program opens.
We reserve the right to grant, modify, or revoke role assignments at any time. Sign-up for an account does not guarantee admission to either program.
3. Acceptable Use
You agree not to, and not to attempt to:
- Reverse engineer, decompile, or disassemble any portion of the Service, or extract the underlying source code or algorithms, except to the extent expressly permitted by applicable law.
- Scrape, copy, or systematically harvest content from the Service without our prior written permission.
- Use automated means (bots, crawlers, etc.) to access the Service except as expressly permitted by our
/robots.txtfile. - Upload, post, or transmit content that is unlawful, defamatory, fraudulent, harassing, infringing, or otherwise harmful.
- Impersonate any person or entity or misrepresent your affiliation with any person or entity, including in a referee application.
- Probe, scan, or test the vulnerability of the Service, breach any security or authentication measures, or interfere with the Service or any user's use thereof.
- Use the Service to develop, train, or evaluate any competing product or service without our prior written consent.
4. User Content
“User Content” means any content you submit to the Service, including but not limited to test data, build records, media (photos, videos, recordings), comments, verdicts, and profile information. You retain ownership of your User Content. You grant EMGravity a worldwide, non-exclusive, royalty-free, sublicensable license to host, store, reproduce, modify, create derivative works of, publicly display, and publicly perform your User Content solely for the purpose of operating, improving, and promoting the Service.
Referee comments and verdicts are subject to administrator moderation. Approved comments and submitted verdicts are published under your name (or the name on file with your account). You represent and warrant that you have all rights necessary to grant the foregoing license and that your User Content does not infringe the rights of any third party.
5. Intellectual Property
All right, title, and interest in and to the Service, including all content (other than User Content), software, designs, trademarks, and underlying technology, are owned by EMGravity or its licensors and are protected by intellectual property laws of the United States and other jurisdictions. EMGravity is the owner of US Provisional Patent Application No. 64/036,293, which is referenced for informational purposes only and does not grant any license, right, or permission to use the underlying invention. No rights or licenses are granted by implication, estoppel, or otherwise.
6. License to Use the Service
Subject to your compliance with these Terms, EMGravity grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to access and use the Service for your personal, non-commercial purposes (or, where applicable, for evaluating the technology in connection with a prospective license or partnership).
7. Technology Licensing & Commercial Inquiries
Information published on the Service regarding licensing, partnership, or investment opportunities is for general informational purposes only and does not constitute an offer or a contract. Commercial terms are governed exclusively by a separately executed written agreement between you (or your organization) and EMGravity.
8. Forward-Looking Statements & Scientific Claims
The Service contains forward-looking statements about technical capabilities, performance, and program timelines. These statements reflect current expectations and are subject to material change. The underlying scientific framework is empirically tested but not yet independently replicated. See our Disclaimer for additional information.
9. Termination
We may suspend or terminate your access to the Service at any time, with or without notice, for any reason, including for violation of these Terms. You may stop using the Service and request account deletion at any time by contacting us. Sections intended by their nature to survive termination (including Sections 4–6, 8, 10–14) survive.
10. Disclaimers
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. EMGRAVITY DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT ANY INFORMATION OR DATA OBTAINED THROUGH THE SERVICE IS ACCURATE OR RELIABLE.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL EMGRAVITY OR ITS PRINCIPALS, OFFICERS, EMPLOYEES, AGENTS, SUPPLIERS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUES, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH THE SERVICE, WHETHER BASED ON CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, OR ANY OTHER LEGAL THEORY, AND WHETHER OR NOT EMGRAVITY HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. EMGRAVITY'S TOTAL CUMULATIVE LIABILITY ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS (US$100). SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES; IN SUCH JURISDICTIONS THE FOREGOING LIMITATIONS APPLY TO THE FULLEST EXTENT PERMITTED.
12. Indemnification
You agree to indemnify, defend, and hold harmless EMGravity and its principals, officers, employees, and agents from and against any third-party claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of (a) your use of the Service, (b) your User Content, or (c) your breach of these Terms.
13. Governing Law & Disputes
These Terms are governed by the laws of the State of Arizona, United States, without regard to its conflict-of-laws rules. The federal and state courts located in Maricopa County, Arizona, will have exclusive jurisdiction over any disputes arising out of or relating to these Terms or the Service, and you consent to personal jurisdiction in those courts. The U.N. Convention on Contracts for the International Sale of Goods does not apply.
14. Export Compliance
The Service may be subject to U.S. export controls, including the Export Administration Regulations (EAR) and economic sanctions administered by the Office of Foreign Assets Control (OFAC). You represent that you are not located in, organized under the laws of, or ordinarily resident in any country or region subject to comprehensive U.S. sanctions, and that you are not on any U.S. government restricted-party list. You will not export, re-export, or transfer any portion of the Service or derived information in violation of any applicable export laws.
15. Changes
We may modify these Terms from time to time. Material changes will be reflected by an updated Effective date and, where appropriate, additional notice (such as an in-product notification or email). Continued use of the Service after the Effective date constitutes acceptance of the modified Terms.
